Welcome to Country Clubbin. In these Terms of Service, "we," "us," and "our" mean Country Clubbin LLC. "You" means the person using this store. These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, govern your use of this website and any purchase you make from us. By using this site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

This store is powered by Shopify, which provides the platform that lets us sell to you.

1. Eligibility

You must be at least the age of majority in your state or province of residence to use this store. You are responsible for activity that occurs under your account and for keeping your account credentials secure.

2. Our products

We work hard to represent our products accurately. Colors and finishes may still look different on your screen depending on your device and its settings. Our products are made in small runs, so minor variation between units is normal and is not a defect. Product descriptions, availability, and pricing may change at any time without notice, and we may limit quantities per person or per order.

3. Limited drops and pre-orders

Country Clubbin sells in limited drops. Quantities are capped and a drop that sells out is not restocked. Some drops are sold as charge-now pre-orders, which means your card is charged at checkout to reserve a unit and the item ships on the timeline stated on the product page. Production and delivery timelines are estimates, not guarantees. If a drop cannot be produced, we will cancel the affected orders and refund them in full.

4. Orders and acceptance

When you place an order you are making an offer to buy. We may accept or decline any order at our discretion, including orders that appear to be for resale, orders that exceed a stated per-customer limit, and orders we cannot verify. Your order is accepted when we confirm it. If we decline or cancel an order, we will contact you using the email, phone number, or address you provided and refund any amount charged.

5. Pricing, payment, and taxes

Prices are shown in US dollars and may change without notice. The price that applies is the one in effect when your order is placed, as confirmed in your order confirmation email. Unless stated otherwise, posted prices do not include taxes. You represent that you are authorized to use the payment method you provide and that the information you enter at checkout is accurate. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel the order and refund you in full, even after the order was placed.

6. Shipping, returns, and refunds

Shipping timelines, rates, and carrier terms are set out in our Shipping Policy. Returns, cancellations, and refunds are governed by our Refund Policy. Both are published on this site and are part of these Terms. Title and risk of loss pass to you when we hand your order to the carrier. We are not responsible for carrier delays.

7. Intellectual property

The Country Clubbin name, the Jimothy character, our logos, product designs, artwork, photography, copy, and the look and feel of this site are owned by Country Clubbin LLC or its licensors and are protected by intellectual property law. You may use this site for your own personal, non-commercial use. You may not copy, reproduce, resell, modify, or create derivative works from our products, artwork, or content without our written permission. Buying a product does not transfer any intellectual property rights in its design.

8. Your content and feedback

If you send us ideas, feedback, reviews, photos, or other content, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display it, including for marketing. You confirm that you own or have the rights to anything you send us and that it is not unlawful, defamatory, or infringing. We are not obligated to keep feedback confidential or to compensate you for it.

9. Acceptable use

You may use this site only for lawful purposes. You may not use it to break the law, infringe anyone's rights, harass anyone, transmit malware, scrape or harvest data, impersonate another person, or interfere with the security or operation of the site. We may suspend or terminate your access at any time if we believe you have violated these Terms.

10. Third-party services and links

This site may link to or embed services operated by third parties. We do not control those services and are not responsible for their content, products, or practices. Please review their terms and policies before using them.

11. Relationship with Shopify

Country Clubbin is powered by Shopify, which enables us to provide this store to you. Any sale or purchase you make here is made directly with Country Clubbin LLC. Shopify is not responsible for any aspect of a sale between you and us, including any injury, damage, or loss resulting from a purchased product. You release Shopify and its affiliates from claims arising from your purchases and transactions with Country Clubbin.

12. Disclaimer of warranties

Except where expressly stated by us in writing, this site and everything sold through it are provided "as is" and "as available," without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error free. Some jurisdictions do not allow these disclaimers, so parts of this section may not apply to you.

13. Limitation of liability

To the fullest extent permitted by law, Country Clubbin LLC and its owners, employees, contractors, suppliers, and service providers will not be liable for any indirect, incidental, special, punitive, or consequential damages, including lost profits, lost data, or replacement costs, arising out of your use of this site or any product bought through it. To the fullest extent permitted by law, our total liability for any claim relating to a product or to this site will not exceed the amount you paid for the product giving rise to the claim.

These Terms are governed by the laws of the State of Colorado, without regard to its conflict of law rules. You and Country Clubbin LLC agree to the exclusive jurisdiction and venue of the state and federal courts located in Denver County, Colorado.

16. Severability, waiver, and entire agreement

If any provision of these Terms is found unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest of these Terms will remain in effect. Our failure to enforce any right is not a waiver of that right. These Terms, together with the policies referenced in them, are the entire agreement between you and us regarding this store.

We may update these Terms at any time by posting a revised version on this page. Continued use of the site after we post changes means you accept them. Please check this page periodically.
